Kwickie collects, holds, uses and discloses Personal Information that you voluntarily provide when applying or registering for a Kwickie account. Kwickie may combine the information you provide voluntarily with other Kwickie or third parties to enhance your user experience.
WHAT CONSITUTES “PERSONAL INFORMATION”?
Personal Information is any information or opinion (whether fact or not) which either identifies you or from which your identity can reasonably be determined.
INFORMATION WE COLLECT
When you register with or visit the Kwickie website, or download the Kwickie Mobile Application and/or any other service or application of Kwickie, Kwickie may collect usage information and device information as outlined below.
When you apply or register to access the Kwickie Service, we may collect information such as your username, password, name, date of birth, gender, email address, home or work address, telephone number, your user image as well as demographic information, such as your zip or postal code and country.
We collect information through your use of the Kwickie Service such as your mobile phone number, photographs, videos, comments and posts.
If you connect to the Kwickie Service through your Facebook or Twitter account, you authorise us to collect your linked authentication details such as your username, name, email address and any other Personal Information available on or through your Facebook or Twitter account including gender, country and town, profile pictures, photographs, videos and comments.
We collect the content you provide from your interactions with the Kwickie Service, including searches, your use of such search results, selections which you make, downloads and streams that you initiate and/or complete, comments, reviews, your responses to advertisements, your interactions with persons who send you e-mails or other communications (the text of e-mails will not be processed), frequency with which you visit or use the Kwickie Service, length of usage, transaction related information, customer service usage, and details, interests and behaviour relating to transactions, products, services and activity in connection to the Kwickie Service.
When you use Kwickie Service on a mobile device, we may collect, hold, use and disclose different types of information about your location, including general information such as your IP address and zip or postal code, as well as more specific information such as your GPS-based location. If you access the Kwickie Service through a mobile device and you do not want your device to provide us with location-tracking information, you can disable the GPS or other location-tracking functions on your device, provided your device allows you to do this. See your device manufacturer’s instructions for further details.
We collect log file information when you use our services and the information we collect includes the referrer URL (the address of the site that has been accessed before), the hostname of your computer (IP address), the time and date of access and the pages viewed.
When you use the Kwickie Service, our server may send small data files known as ‘cookies’ and other similar technologies to your device. We may also allow our business partners to use their cookies and other tracking technologies on the Kwickie Service platform. When you revisit or re-use the Kwickie Service, the cookies allow the site to recognize your browser, making your experience on the Kwickie Service more convenient and personal. The cookies may also store your preferences and other information that will allow us to tailor and simplify your experience when using the Kwickie Service.
You have the option of changing your browser preferences to not allow cookies or even request your permission to send cookies. However, some Kwickie features may not function correctly without cookies enabled. Most of Kwickie’s features rely on the voluntary information you provide through your member profile, which you will have access to manage and update.
Please note that the Kwickie Service may be co-branded and offered in conjunction with other websites and/or services provided by unrelated third parties, and/or linked social media accounts such as Facebook and Twitter. If you register for or use such a service, the other party may also receive Personal Information collected in conjunction with the co-branded service. Other partners (i.e. advertising clients advertising on Kwickie, as well as those who provide for advertising supported entertainment products and other internet sites and services accessible via the website) may also collect data about you.
COMPETITIONS, PROMOTIONS OR SWEEPSTAKES
USE OF PERSONAL INFORMATION
Kwickie uses the information we collect and hold, including your Personal Information, in the following ways:
• to enable you to access and use the Kwickie Service;
• to deliver and fulfil the Kwickie Service or carry out the transactions you have requested (including but not limited to downloads, streams, caching, purchases and resolution of issues which you encounter);
• to provide, personalise and improve the Kwickie Service in line with our users’ needs and to display content and targeted advertising that is customised to their interests and preferences;
• to ensure technical functioning of the Kwickie Service and analyse your use of the Kwickie Service, including your interaction with applications, advertising, products and services that are made available, linked to or offered by the Kwickie Service;
• to administer rewards, surveys, sweepstakes, contests, or other promotional activities or events sponsored or managed by Kwickie or our partners;
• to comply with our legal obligations, resolve any disputes that we may have with any of our users, and enforce our agreements with third parties;
• to communicate with you about the Kwickie Service such as service notices, reminders and administrative messages, reminders, technical notices, updates, security alerts and information requested by you; and
• to send you marketing and promotional messages and other information that may be of interest to you, including information about Kwickie or general promotions for partner campaigns and services.
SHARING INFORMATION SOCIAL MEDIA
The Kwickie Service links and integrates with various social media programs including Facebook, Twitter. Much of the information which you choose to be publically available shall be available by default, including your username, profile picture, videos, any friends or playlists you are following, or those following you, your recent activity and any content you post or upload.
Kwickie occasionally employs third parties to provide services on its behalf, such as handling the bandwidth and storage necessary to perform the Kwickie Service, or performing statistical analysis. The access of such parties to your Personal Information will be limited to the data they need in order to deliver the service.
Kwickie may also share information in order to obtain content from third parties, analyse usage patterns, provide demographic information, assist in design of advertising campaigns and other similar uses that will facilitate third party contacts in appropriate cases with parties selected by Kwickie, as well as to prevent, investigate or take action regarding suspected fraud and other illegal activities, as well as situations involving potential threats to the physical safety of any person and violations of Kwickie’s Terms of Service.
We may access and/or disclose your Personal Information if we, in our sole discretion, deem it necessary to:
• comply with applicable laws
• respond to subpoenas, court orders, or legal process
• establish or exercise our legal rights or to defend ourselves against legal claims
• respond to any relevant legal court order or subpoena, and/or in order to comply with any applicable law
• protect the safety of any person
• enforce Kwickie’s Terms of Service
• prevent, investigate or address fraud, security or technical issues
• advise our partners of the usage of the Kwickie Service, in the form of non-personal statistics and data
CHANGE OF CONTROL
If we sell, assign or otherwise transfer part or the whole of the Kwickie business, your Personal Information, which was collected by us through your use of the Kwickie Service, may be among the items transferred or sold to the extent that it is relevant to Kwickie’s business.
TRANSFER TO OTHER COUNTRIES
Kwickie may also subcontract processing to or share your information with third parties located in countries, other than your home country. Third party service providers will have access to your Personal information only to the extent that it is reasonably necessary to provide the Kwickie Services. Please note that laws vary from jurisdiction to jurisdiction, and so the privacy laws applicable to the places where your information is transferred or collected, held, used, disclosed or processed in, may be different from the privacy laws applicable to the place where you are a resident.
You expressly consent to your information being used as set out in this section.
STORAGE OF INFORMATION
Should you close your account with us, we will retain certain information associated with your account for analytical, archival or audit purposes.
Can you object to giving your personal informaiton?
Should you choose to use the Kwickie Service, we will require your Personal Information so that we are able to provide the services.
You can control information collected by cookies. You can delete or decline cookies by changing your browser settings. Other than deleting or declining cookies, you cannot restrict or limit the disclosure of your Personal Information when using the Kwickie Service.
You may opt out of receiving notifications and correspondence from us at any time by clicking on the “Unsubscribe” link at the bottom of each communication, or alternatively by contacting Kwickie support at firstname.lastname@example.org.
CAN YOU ACCESS PERSONAL INFORMATION?
You may request access to your Personal Information at any time, and we will provide access to your information. In order to respond to your request, we may require the following information to be provided:
your name and address; your contact telephone number(s); and your Kwickie username.
This service is usually provided free of charge and we ask that the request be made in writing. Should the information you require be held in our archives, there may be a small administration fee charged to assist with meeting this cost. Prior to acting upon your request we will advise you of any fees which may be payable.
We will act on all such requests as soon as reasonably possible on receipt of the request.
UPDATING YOUR PERSONAL INFORMATION
We will take steps to ensure that your Personal Information is accurate, up to date and complete, and to update information where we are advised of changes.
To ensure we can provide you with the best possible service, it is important to ensure your information is accurate, up to date and complete. Should there be any change to your Personal Information, we ask that you update us as soon as practicable. We will update your details upon receiving instructions from you to do so.
You may review, update, correct or delete the Personal Information on your Kwickie Account at any time. If you would like to correct your information or cancel your Kwickie account entirely, you can do so by logging in to your account.
USE OF SERVICE BY CHILDREN
The Kwickie Service is a general audience service. We do not knowingly collect personally identifiable information from visitors under the age of 13. Kwickie collects, uses and discloses information on users aged 13-18 in the same manner as it does for adults. If you are under the age of 18, you must obtain your parent’s permission before disclosing any information on this site.
Kwickie works with secure data networks protected by both industry-standard firewalls and by passwords. We continuously implement and update security measures in order to safeguard your Personal Information. We also limit access to Personal Information to those Kwickie employees (and those employees of our affiliates) that we believe reasonably need to come into contact with that information to provide our products and services to you.
If a username and password is used to help to protect your account from unauthorised access, you must keep such login data confidential and must not disclose it or share it with anyone. We recommend that you select a unique and strong password to prevent unauthorised access to your account. If you have used a shared device, you must ensure that you sign out.
We work to protect the security of your information during transmission by using secure sockets layer software, which encrypts information you input. Kwickie will endeavour to take all reasonable steps to protect your Personal Information, however no method of transmission over the Internet and no method of storing electronic information can be 100% secure, and we do not guarantee the security of user information at any time. Users should take care with how they handle and disclose their personal information, particularly on publically-viewable pages.
Kwickie abides by the ‘safe harbour’ frameworks set forth by the US Department of Commerce regarding the collection, use and retention of personal information collected by organisations in the United States, European Economic Area and Switzerland.
Where there are any translations of this Agreement and to the extent of any inconsistency, the English version shall prevail.
